General Terms - Vegas Mobile DJ Studio Rental - The DJ Sessions (TDJS)
A complete event participation and video/audio broadcast waiver will be required by all participants and the guests accompanying them. Participants should not purchase rental or marketing packages without first reading all terms and conditions below. Refusal to participate due to a listed term below is not a valid excuse or disputable claim.
Operation/Ownership: The Mobile DJ Studio is operated by The DJ Sessions (herein, “TDJS”), a Washington State company, as a unique marketing opportunity for DJs and businesses promoting products via their video screens, truck wraps, and social media content.
Mobile Studio Not Designed As Passenger Travel Vehicle or “Vehicle for Hire” (such as a private motorcoach, taxi, sedan, or rideshare): The studio is not public or private passenger transit, nor is the vehicle designed for this purpose. The vehicle is a mobile studio designed for mobile audio, video, and marketing production and rented by entertainers and other commercial vendors engaged in the production of such marketing or media. This is a commercial activity conducted by those in the entertainment, film, media, or marketing field. No passengers will be picked up or allowed to depart at locations other than the departure location, except for rest breaks or emergencies.
The driver, its employees, contractors or assistants, will operate the motor marketing vehicle in a safe manner, however, be it made known before purchasing a marketing package or studio rental, that:
Assumption of Risks: The studio, as any flatbed truck, is bumpy at times, and subject to hard stops, turns, or evasive maneuvers to protect the truck and passengers from harm or death.
Participants at all levels participate at their own risk of accidental (not malicious) bodily harm, permanent injury, or death. As with most truck beds, the studio area is not primarily designed for passengers and is not equipped with safety devices found in motor carriers, such as appropriate seats, safety belts, airbags, or netting. Bars are installed for participants to hold on to while in motion and ad hoc seats are provided. Participants are safest when seated on the floor of the truck bed, away from the rear door, or holding onto the welded bars or attached straps.
Participants must not sit, stand, or lean against the rear door or open hatch, netting, equipment, or straps, as a sudden turn, stop, accident, or acceleration could cause a participant to fall out of the studio or accidentally open the door while in transit causing personal injury or death, or property damage or loss.
Depending on the comfort level of all participants and local regulations, the rear door may operate in an open position with a high-strength cargo strap installed on the rear door in case of falls, sliding, or other passenger peril. This strap is not designed to, nor is it safe to, lean on/against, over, or slide under this strap while the studio is operating and the rear door is open. While it may provide a last resort option, it is not designed as a life-saving device.
Those with preexisting health conditions (including but not limited to heart issues, high blood pressure, pregnancy or possible pregnancy, hearing or vision loss, diabetes, fainting spells or seizures, broken or healing bones, ligaments, muscles, those requiring assistive devices - including but not limited to wheelchairs, artificial limbs or implants), or those that are under the influence of physical or judgment-impairing drugs or alcohol, should not purchase a ride or rental package. If, at the discretion of TDJS, the studio operator, owner, or driver, the participant is not fit for travel, the participant or participants may be refused the rental package reserved without refund, or at their option, TDJS, its operator or driver may (but is under no obligation to do so) agree to postpone travel to any other available slot that is unsold on that or a future day.
Release and Hold Harmless: In order to participate, you further accept the condition of holding harmless, The DJ Sessions, its sponsors, advertisers, ownerships, partners, or heirs and assigns, for any physical or emotional injury, loss, or future injury, death, illness, or losses, in connected with the participation in the event/activity.
Injury/Accident: You further agree to report any injury to the driver immediately by calling 9-1-1, and/or knocking on the cab, which will indicate to the driver to immediately pull over to a safe location, in the event this does not alert the driver, you agree to either sound a provided air horn, or call the driver on his/her mobile phone for non-urgent assistance. All participants will sign a full personal and property release form prior to participation, and upon the conclusion of the event stating the same, and reaffirming the hold harmless clause.
Those under the apparent influence of judgment-impairing drugs or alcohol, should not purchase a ride or rental package. If, at the discretion of TDJS, the studio operator, owner, or driver, the participant is not fit for travel, the participant or participants may be refused the rental package reserved without refund, or at their option, TDJS, its operator or driver may (but is under no obligation to do so) agree to postpone travel to any other available slot that is unsold on that or a future day.
Participants that vomit, soil, or cause other bio-hazard cleaning will be charged an additional $150.00USD for the cleaning and delay to the next group of renters.
Audio/Video Release: The studio is being rented by the occupants for the opportunity to record unique video and photographic footage for print, video, audio, and social media campaigns by the participants and The DJ Sessions, and its owner and sponsors. By participating in this event, you must provide a full and public release for any and all sponsors, partners, owners, media, social media platforms, or promoters. Participants are encouraged to have fun, but also mindful of their actions - as these actions may be permanently available online and in other video or photographic formats for public consumption, with or without their knowledge.
Ownership of Audio/Video Content Created Onboard the Mobile DJ Studio: By participating in this activity, you agree that all actions, on, and near (within video and audio transmission range) the studio and truck cab, can and will be recorded using audio and video devices. This recorded or broadcasted footage may be streamed live to news, radio, social media outlets and other media partners for instant and future use. Participants must be in control of their actions, comments, and implied actions or comments.
Intellectual Property Rights: All participants and TDJS agree that:
Still, video, virtual reality, or audio footage captured and controlled by renters/participants is the intellectual and owned property of the participant or their work-for-hire photographer, videographer, or recording artist (subject to separate contractual agreement or financial obligations) and can be used in any legal manner without the expectation of future payment of any royalties, salary, per diem, day rate, scale, or compensation to the owner, lessee, or future owners, lessees or licensees.
Still, video, virtual reality, or audio footage captured and controlled by TDJS or its employees or contractors, is the intellectual and owned property of TDJS and/or their work-for-hire photographer, videographer, or recording artist (subject to separate contractual agreement or financial obligations) and can be used in any legal manner without the expectation of future payment of any royalties, salary, per diem, day rate, scale, or compensation to the owner, lessee, or future owners, lessees or licensees.
DJs are encouraged to use broadcast safe and non-copyright infringing audio, as livestream partners may block content from infringing performers, rendering the audio useless or muted. There is no expectation or guarantee of livestream content or participation.
Cancellations: Full refunds will be provided if the mobile studio is not ready and available within 90 minutes of scheduled departure time. A refund, minus a 20% booking and administrative fee will be provided in the following situations only:
Delayed flight (with proof of purchased ticket) and notice provided to TDJS or rental coordinator at least two hours prior to scheduled departure.
COVID-19 positive test (with poof of positive PCR test within 9 days if not vaccinated or 6 days if vaccinated and boosted)
On a case-by-case, at the discretion of TDJS or the operator, for extreme emergencies (including but not limited to death, hospitalization or accident) with proof of each.
In all other cases, a no-show, or cancellation will result in a full loss of funds paid, UNLESS, the participants can find a suitable substitute for their rental and communicate this to the operator or TDJS. In such cases, there is no guarantee that DJ/company logos or media will be ready or available for display in the broadcasted video or on the outward facing video screens.
Use of Equipment: DJs may bring their own media on a thumb drive in MP#/MP4 format, headphones, or microphone(s). A Pioneer controller is in place in the truck. If the group can install one different controller of their choice and reinstall the original controller (time to be deducted from rental time over 10 minutes), the group or DJ may provide his/her own controller. All personal equipment and personal belongings are the responsibility of the participant and risk of damage or loss rests solely with the participant.
